In an email dated 23 novembre to the trustee, Mirax informed the trustee that ’the main shoareholder (of Mirax) has — taken the decision to engage a professional bank — MFK Bank to represent Mirax to its creditors and to find a beneficial solution to all its creditors. Mfk and Mirax are due to publish the official joint letter tomorrow morning (24 november 2009)’. The trustee has yet to receive a copy of such letter and have received no further information from Mirax. 2. Noteholders are reminded that they may instruct the trustee to take action under the trust deed, loan agreement and guarantees and noteholders should refer to the conditions of the notes, the pricing supplement and other transaction documents as relevant to determine what action, if any, they wish the trustee to take. 3. To facilitate communication between the noteholders and the trustee, the trustee: a) Has scheduled an informal noteholder conference call at 11. 00 am (London time) on thursday 3 december 2009. Only noteholders and the trustee will be permitted to participate in the call and it will be an opportunity for noteholders to discuss the present situation among themselves and discuss next steps. all noteholders are encouraged to participate in the call. b) Has established a noteholder contact list. All noteholders wishing to add their name to the list should contact the trustee in the manner described in the actions to be taken part of this notification, and authorize it to do so. The noteholder contact list will only contain contact details of each noteholder will not include information on a noteholder’s position in the notes. the list will be distributed only to those noteholders on the list. c) Generally encourages noteholders to make themselves known to the trustee, in the manner described in the actions to be taken part of this notification, to facilitate communication with the trustee. The trustee will not divulge the identity or details or a noteholder to any other person unless such noteholder gives it permission to do so the trustee will send the dial-in details of the noteholder conference call by email to all those noteholders who have provided disclosures.
