The trustee hereby inform you that:
(1) on 20 February 2009, the issuer gave the trustee written notice of the occurrence an event of default under condition 10 (a) (failure to pay) of the notes. the event of default was caused by the borrower failing to pay the first interest payment under the loan agreement that was due on 31 december 2008 and accordingly, the interest that was due on the notes on the first interest payment date could not be paid by the issuer
(2) pursuant to condition 10, if an event of default has occurred, the trustee at its discretion may, and if so requested in writing by holders of at least 25 per cent in principal amount of the notes then outstanding or if so directed by an extraordinary resolution of the holders of the notes shall (subject in each case to being indemnified and/or secured to its satisfaction), give written notice to the issuer that all of the notes are, and they shall thereupon become, immediately due and payable at their early redemption amount ( as described in condition 6.4)  together with accrued interest as provided in the trust deed.

No further action by trustee: the trustee has appointed english legal advisers but does not presently intend to take any action in respect of paragraphs 1 and 2 above unless the requisite percentage of holders instruct it otherwise in accordance with the trust deed and the trustee is indemnified or secured to its satisfaction.

Concurrently, the trustee, in order to facilitate any communications with the holders and the provision of information such as documents, hereby invites all holders to make themselves known to the trustee and to verify their holdings of the notes to the trustee.
