Корпоративное действие GREENWICH AVENUE — a notice on introduction of insolvency supervision

We have been advised by euroclear than on 3rd september 2011, a notice was published in the russian newspaper, kommersant, stating that, by the ruling of the arbitration court of the city of moscow dated 19 august 2011 (prepared in full on 26 august 2011), an insolvency supervision was introduced in relation to open joint stock company -finance leasing company- and that claims of creditors should be received for consideration by the arbitration court within one month from the date of publication of the announcement, namely by 3rd october 2011. The notice also stated that the date set for the court hearing on the insolvency procedure is 10 february 2012 at 9.30 a.m. in the arbitration court of the city of Moscow.
Under the clause 6.7 of the supplemental trust deed, upon giving written notice to the issuer, the trustee may enforce the security created under the supplemental trust deed, which would include filing a claim as a creditor with the arbitration court of the city of moscow, but the trustee is not obliged to take any such action unless: (a) it is requested to do so in writing by holders of at least one quarter in principal amount of the notes then outstanding or by an extraordinary resolution of the noteholders, and (b) it is indemnified to its satisfaction.
Holders who wish to request or direct the trustee to file a claim as creditor with the arbitration court of the city of moscow by 3rd october 2011 and to take any other steps or action in respect thereof and to indemnify the trustee should disclose their identity to the trustee and provide satisfactory indemnity to the trustee.
